TITLE SEARCH & TITLE INSURANCE

Reviewing a real estate contract

Title Search & Title Insurance

Understanding title is an important part of a property purchase. We investigate registered interests and explain relevant title insurance arrangements.

Signing legal documents

Reviewing registered interests

Title records may identify mortgages, easements, restrictions, and other registrations. We examine matters relevant to the transaction and raise legal questions with the other lawyer where appropriate.

Understanding the insurance policy

Title insurance coverage depends on the policy and its exclusions. We explain the proposed coverage in the context of your purchase; insurance does not replace every search or address every property risk.

Ownership and registered interests

Title review helps establish the registered owners and the interests recorded against the property. Mortgages, liens, easements, restrictive covenants, and other instruments can affect a purchase or refinance. The legal significance depends on the documents and your intended use.

Questions to raise early

Tell us about shared access, unusual boundaries, parking arrangements, or planned construction. A survey, municipal record, inspection, or specialist opinion may be relevant in addition to the title search.

What title insurance can and cannot address

Title insurance is a contract with defined coverage, exclusions, and conditions. Depending on the policy, it may address certain title defects, fraud risks, or other specified issues. An owner’s policy and a lender’s policy protect different interests.

Review the actual coverage

We discuss the policy relevant to the transaction and identify known issues requiring attention. Insurance is not a substitute for investigating a disclosed problem or confirming that a proposed use is permitted.

Responding to title concerns before closing

A search result may require clarification, a discharge, additional documentation, an agreed closing arrangement, or advice about proceeding. We explain the issue and communicate with the other parties within the scope of the retainer.

After registration

Keep your final reporting documents and policy information. They provide a record of the transaction and help identify the appropriate next step if a title-related concern later arises.

Provide context for the title review

A title question should be considered against what you want to do with the property. Explain unusual access, neighbouring structures, or discrepancies in the records. We discuss whether the issue needs further documents, correction, insurance consideration, or advice about the available closing arrangements.

Documents to prepare

  • Property address and legal description if available
  • Existing survey and information about boundaries or shared access
  • Agreement and lender requirements
  • Details of intended renovations or changes in use
