Buying from an Estate: Authority, Documents, and Practical Closing Questions

Confirm the capacity in which the seller acts

An estate transaction requires attention to who has authority to sell and sign. The title records and supporting estate documents matter alongside the agreement. Do not assume that a family connection alone establishes the authority needed to transfer the property.

Read the seller’s promises carefully

Estate agreements may address what the seller knows, what documents are available, and the terms concerning condition or possession. The buyer should understand the actual representations rather than expect the same knowledge as an owner who recently occupied the property.

Allow for document and timing issues

Estate administration, court documentation, mortgages, and occupation can affect the closing plan. A proposed date should be considered against the documents that must be obtained or reviewed. Identify any linked sale or financing deadline so potential timing issues can be discussed early.

Plan appropriate investigation

Send the agreement and available records, and arrange any physical inspection or other specialist review relevant to the purchase. Maki Law can assess the legal closing documents and discuss authority questions within the retainer. Separate estate or tax advice may also be required for the parties.
