Buying a Home with Solar Panels: Questions About Ownership, Contracts, and Closing

Start with who owns the equipment

Solar panels can be owned by the seller or connected to a financing, rental, or other contractual arrangement. Before treating them as an included feature, ask for the documents explaining ownership and any ongoing obligations. The equipment’s presence on the roof does not answer those questions.

Read the agreement and related contracts

The sale agreement should be considered alongside the equipment contracts, available installation records, and any assignment requirements. Ask who must obtain consent or complete paperwork before closing, and whether the buyer will take over payments or other commitments. A verbal assurance may not match the written terms.

Separate legal and technical review

The legal review can address the contracts and title interests relevant to the transaction. A qualified technical professional should address installation, condition, roof impacts, and expected performance. Confirm any insurance or financing implications with the relevant provider rather than assuming the panels are acceptable to every lender.

Prepare the records before the deal becomes firm

Send the agreement, seller’s equipment documents, and any notices affecting the system. Identify whether ownership or ongoing payments matter to your budget. Maki Law can discuss the legal issues and documents needed to clarify what you are buying and the obligations that may continue after closing.
