Mortgage funding is central to many closings. We assist with the legal documentation and registration requirements associated with your lender’s instructions.
Provide the lender’s details early and confirm that instructions will be sent to our office. Changes to borrowers, ownership, or loan terms may require updated documentation.
We explain the legal documents we prepare within our retainer. Ask your lender or broker about approval, rates, and funding conditions; tell us immediately if your financing arrangements change.
Mortgage approval is not the same as receiving complete legal instructions for closing. We review the lender’s documents within the retainer and identify requirements for registration, insurance, ownership, and funding.
Raise questions about interest, repayment, renewal, prepayment charges, guarantees, and additional security before signing. Some questions need confirmation directly from the lender or mortgage broker.
A private mortgage or additional charge can involve different fees, repayment arrangements, and priority requirements from a standard institutional loan. The existing title and other secured borrowing can affect what a new lender requires.
Tell us who is borrowing, guaranteeing, or providing security. The parties’ interests determine representation and whether separate legal advice may be required.
The closing process may involve title inquiries, discharge of existing charges, execution of security documents, and satisfaction of the lender’s conditions. Funding depends on receiving both the instructions and the required information in time.
Advise us promptly if the lender, loan amount, ownership, or completion date changes. Provide your broker’s contact information and identify any linked purchase, sale, or refinance.
A financing change can affect the legal documents even where the property and closing date remain the same. Explain any private lender, additional charge, guarantee, or ownership change before documents are prepared. We discuss representation, registration requirements, and what must be received before funding can be requested.
